Clarification of Morning Star Road Trail extension

In response to Cave Creek Town Manager Grady Miller’s comments on March 20, 2024 in Sonoran News, this is being submitted for further clarification of facts and to correct inaccuracies.

In 2015 William J. Sims III was the Legal Counsel for the AMRRP and remains in that position today.

AMRRP is a Municipally-Governed Risk Pool Dedicated Solely to Coverage and Risk Management Solutions for Arizona Cities and Towns.

Sims is also the Town Attorney for Cave Creek, AZ. then and now.

In 2015 Sims Murray Law Firm assumed the legal defense of Mark Stapp’s MorningStar Road Properties Inc. lawsuit. Stapp was attempting to use part of that driveway in a gift to the Town of Cave Creek for a trail.

Is it a coincidence that the Legal Counsel for the AMRRP awards defense entitlement under AMRRP membership to his own Law firm?

Sims Murray law firm’s legal defense charges for the Town of Cave Creek are covered under AMRRP membership.

Sims Murray assumed legal defense for the Town of Creek and the Town of Cave Creek assumed those charges on behalf of Mark Stapp’s MorningStar Road Properties Inc.

It is obvious and fair to say the Town picked up and paid for Mark Stapp’s MorningStar Road Properties Inc. defense by virtue of the Town’s Membership in the AMRRP.

The question is why did the Town pay for the defense of Mark Stapp’s MorningStar Road Properties Inc.? Would they do this for every citizen? Why just Mark Stapp?

There is an open, legal and enforceable injunction of 9 counts that must be upheld in the event of a trail on the MorningStar Road Properties Inc. Parcel.

The proposed trail ends at a privately owned driveway for 2 resident’s homes.

Petitions opposing this unpopular trail extension have been submitted to the Town. At this time there are 125 signatures and still growing.
