Klayman files petition, makes solid case for deporting Obama

larry k;aymanWASHINGTON – On Oct. 2, Attorney Larry Klayman (r), a former U.S. Department of Justice attorney and founder of both Judicial Watch and Freedom Watch, filed a petition with Thomas Homan, executive associate director of the Department of Homeland Security (DHS) Enforcement Removal Operations (ERO), Thomas Winkowski, principal deputy assistant secretary of DHS Immigration and Customs Enforcement (ICE), and Sarah Kendall, associate director of the DHS Office of Fraud detection and National Security at the National Security and Records Verification Directorate of Citizen and Immigration Services, to commence deportation proceedings against Barack Hussein Obama for his removal from the United States.

Filed under the banner of Freedom Watch, Klayman submitted the Petition for Administrative Action to Convene an Investigation and Hearing, as provided by statute for removal proceedings concerning Obama.

According to Klayman, and as demonstrated by the evidence established in the exhibits and affidavits submitted with his petition, there is “prima facie evidence” that Obama is removable from the United States and in violation of the law for falsely claiming U.S. citizenship, applying for and obtaining a U.S. passport under false pretences, and document fraud and misrepresentation.

In his cover letter, Klayman asks that the DHS conduct a comprehensive investigation, convene a full evidentiary hearing, and initiate removal and deportation proceedings of Obama.

Concluding his 21-page petition, Klayman states the evidence, which warrants deportation, shows Obama used a falsified and fraudulent birth certificate to enter the United States from Indonesia, committing document fraud as well as fraud and willful misrepresentation, while falsely claiming U.S. citizenship.

Stating Obama was not born in the United States, which Klayman says is indicated by the inference that Obama would not have used a clearly falsified birth certificate if he could have relied upon a genuine birth certificate, with corroborating testimony of his grandmother who claims to have been present at his birth in Mombasa, Kenya, as well as other witnesses.

And, although his mother Stanley Ann Dunham was an American citizen at the time of his birth on Aug. 4, 1961, she was only 18 at the time and not old enough to meet the requirements to convey U.S. citizenship under the law in place at the time.

Section 301 of the Immigration and Nationality Act (INA) at the time required a U.S. citizen married to an alien to be physically present continuously in the United States for 10 years, including five after reaching the age of 14, to transmit citizenship to foreign-born children.

Dunham had only lived in the United States four and a half years from the time she turned 14 until Obama’s birth.

Plus, it appears she may have spent some of those four and a half years outside the United States.

Therefore, Klayman concluded, Obama did not acquire citizenship from his mother.

His father, Barack Hussein Obama, Sr., a citizen of Kenya, was apparently deported from the United States.

However, Klayman notes, Obama, Sr. might have petitioned to remain in the United States if anyone at the time thought Obama were a U.S. citizen.

Klayman points out Obama was legally adopted by his stepfather Lolo Soetoro in Indonesia and was enrolled in government schools as a citizen of Indonesia under the name Barry Soetoro, which he said required legal documentation of his identity and legal name.

While his legal name was changed in Indonesia to Barry Soetoro, his name was never legally changed back to Barack Hussein Obama, but he has gone by that assumed name despite knowing the law as a lawyer.

There are no records that Obama had ever applied for adjustment of status to become a U.S. citizen.

Obama has been using a Connecticut-issued social security number that was not assigned to him and applied for U.S. citizenship under the INA using forged documents, fraud and misrepresentation and falsely claiming to be a U.S. citizen.

Klayman asserts Obama traveled as an adult to Pakistan, Kenya, and possibly Indonesia, using an Indonesian passport as a citizen of Indonesia.

With a mountain of documented evidence included, Klayman wrote, “In sum, deportation proceedings should be immediately commenced, an investigation undertaken, a full evidentiary hearing held, and Barack Hussein Obama should be removed from the United States.”
