Galloway Ridge proposal

SECTION 3.2 TOWN CORE COMMERCIAL (TCC) ZONE A. Purpose: The purpose of the Town Core Commercial (TCC) Zone is to allow for a diverse commercial area to service neighborhood residential and tourist trade. The intent of this zone is to maintain and enhance the character of the community’s Town Core while promoting a pedestrian-oriented specialty retail district.  

  1. All development of TCC zoned properties, regardless of size; require approval of a Site Plan by the Council upon recommendation by the Commission, unless otherwise specified in this Ordinance.
         B. Allowable Uses: 1. See Section 3.5 of this Chapter. 2. Multiple Residences in conjunction with commercial uses (Live/Work).
                a. Residential uses shall be located above, behind or adjacent to the commercial building(s) on a lot or parcel containing mixed commercial and residential uses.
               b. Residential units located or created within the same structure (building) as a commercial use shall not interfere with the ability of the non-residential use to meet the requirements and standards of the TCC zone as outlined within this Ordinance. 
    Dear Council, I hardly think that the current application before you adheres to the spirit of what Mayor Francia, council and citizens approval regarding being able to live above a commercial business for owners.  This application is proposing a future commercial development tied to the proposed  70 living quarters.   *** Hidden Rock got away with the same scenario.  Sept 15, 2014 Francia, Bunch, McGuire, Durkin, Spitzer and Monachino voted YES to approve 49 town homes, 9 of which would have work units in them, 4 custom homes on ridge south of the property.  What is there now should have required a zoning change for a residential subdivision on commercial core property as not one inch of such housing has been built at Hidden Rock nor is their land fronting CC road left for any.  Minutes Hidden Rock: 2014:https://cavecreek.civicweb.net/filepro/documents/21962?preview=21980
    Galloway Ridge is asking you to redo the same mistake.  Haven’t enough mistakes been made by our elected officials and staff these last 8 years that have cost citizens dearly not only in the pocket book of revenue but quality of life? 
    Galloway Ridge should be asking for a rezone  for their 70 residential condos.  There are no living quarters above, behind or adjacent shown on the plat map.  The spirit that sold us on such subdivisions was to have homes above your live/work 1)For folks who are gradually moving into the work force but can’t afford an office and a home. 2)Then there are the retirees who aren’t done yet, so will live above their business.  This type of ordinance was created for a specific developer that has never been built to fruition and never will.  It is simply a way for developers to circumvent our way of life and our General Plan via our elected officials.  We should expect more from you.
    If water is supposed to be bought and delivered to our town by any new development, has Galloway Ridge applicant done this.  Or are you ignoring the new ordinance approved Dec last year?  The Bob Kite Cave Creek Resort and Casita assured water certificate expired 2 years ago and this new applicant with a totally new proposal must reapply to ADWR.  Has that happened?
    The traffic for residents, the library, the post office and the new Mission all using small section of School House for ingress and egress must be causing you concern.  That hill presents a concern also. The Institute of Traffic Engineers say 5.5 vehicle trips per unit per day and imagine adding to that when any commercial comes on that property to boot.  Our safety and welfare belongs in your hands also, not just accommodating a revenue producing enterprise.
    That Galloway Wash is a huge wildlife corridor.  Is it so bad to hope for 9-5 traffic,and noise and lights that commercial core could bring instead of 24/7 to benefit their migration and life patterns.  Our wildlife is so much a part of who we are in Cave Creek.
    Our General Plan 2005 still in force guides us to do differently than what is being proposed.  See attachment GP,   Proposed site plan Galloway #1 and Galloway #2 attachments.
